Terms of Service

1. Acceptance of Terms

By creating an account or using Simmer ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. Simmer is operated by Simmer LLC ("we," "us," or "our").

2. Eligibility

You must be at least 18 years old to use Simmer. By creating an account, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration and to update your information as needed. You must notify us immediately of any unauthorized use of your account.

4. Event Participation and Conduct

Simmer organizes curated dinner events. By attending an event, you agree to conduct yourself respectfully toward other guests, restaurant staff, and event coordinators. We reserve the right to remove any participant who engages in disruptive, harassing, or inappropriate behavior, without refund.

You acknowledge that dinner events involve dining at third-party restaurant venues. Simmer is not responsible for food quality, allergens, or service provided by the restaurant. Please communicate any dietary restrictions or allergies directly to the venue.

5. Payments and Pricing

All payments are processed securely through Stripe. By purchasing a ticket, you agree to pay the listed price at the time of purchase. Prices are displayed in US dollars and include the dinner experience; they do not include gratuity unless stated otherwise.

You agree to provide valid payment information. Simmer does not store your full credit card details — all payment data is handled by Stripe in accordance with PCI DSS standards.

6. Cancellations and Refunds

User-initiated cancellations: If you need to cancel your ticket, please contact us at support@simmer.app. Refund eligibility depends on how far in advance you cancel and is handled on a case-by-case basis.

Event cancellations: If Simmer cancels an event, all ticket holders will receive a full automatic refund to their original payment method. We will notify you via email of any cancellation.

7. Communications

By purchasing a ticket, you agree to receive transactional emails and text messages related to your event, including ticket confirmations, table assignments, venue details, and event updates. These communications are a necessary part of the Service and cannot be opted out of while you hold an active ticket.

You may separately opt in to receive marketing communications about upcoming dinners and updates. Marketing messages are optional and can be opted out of at any time by emailing support@simmer.app or by clicking the unsubscribe link in any marketing email. Standard message and data rates may apply to SMS.

8. Intellectual Property

All content on Simmer — including text, graphics, logos, and software — is the property of Simmer LLC or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any content without our written permission.

9. Limitation of Liability

To the maximum extent permitted by law, Simmer LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to personal injury, property damage, or loss of data.

Our total liability for any claim arising from the Service shall not exceed the amount you paid to Simmer in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Simmer LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We reserve the right to suspend or terminate your account at our sole discretion, with or without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties. Users who are banned from events will have their accounts terminated.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Hudson County, New Jersey.

13. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on the Service. Your continued use of Simmer after any changes constitutes acceptance of the new Terms.
